26 e 27 del decreto legislativo 2 gennaio 2018, n. 1;</p>\n<p><strong>VISTO </strong> il decreto del Presidente del Consiglio dei Ministri del 21 maggio 2012 recante la d ichiarazione dell’eccezionale rischio di compromissione degli interessi primari a causa dei predetti eventi sismici, ai sensi dell’articolo 3, comma 1, del decreto legge 4 novembre 2002, n. 245, convertito con modificazioni dall’articolo 1 della legge 27 dicembre 2002, n. 286;            </p>\n<p><strong>VISTA </strong> la delibera del Consiglio dei Ministri del 22 maggio 2012 con la quale è stato dichiarato fino al 21 luglio 2012 lo stato d’emergenza in ordine agli eventi sismici che hanno colpito il territorio delle province di Bologna, Modena, Ferrara e Mantova il giorno 20 maggio 2012 ed è stata disposta la delega al Capo del Dipartimento della protezione civile ad emanare ordinanze in deroga ad ogni disposizione vigente e nel rispetto dei principi generali dell’ordinamento giuridico;</p>\n<p><strong>VISTA </strong> la delibera del Consiglio dei Ministri del 30 maggio 2012 con la quale è stato dichiarato fino al 29 luglio 2012 lo stato d’emergenza in ordine ai ripetuti eventi sismici di forte intensità verificatisi nel mese di maggio 2012, e in particolare al terremoto del 29 maggio 2012, che hanno colpito il territorio delle province di Bologna, Modena, Ferrara, Reggio Emilia, Mantova e Rovigo ed è stata disposta la delega al Capo del Dipartimento della protezione civile ad emanare ordinanze in deroga ad ogni disposizione vigente e nel rispetto dei principi generali dell’ordinamento giuridico;</p>\n<p><strong>VISTE</strong> le ordinanze del Capo del Dipartimento della protezione civile n. 1 del 22 maggio 2012, nn. 2 e 3 del 2 giugno 2012, n. 4 del 6 giugno 2012, n. 9 del 15 giugno 2012, n. 15 del 1° agosto 2012 e n. 42 del 24 gennaio 2013, adottate per disciplinare l’emergenza in rassegna;</p>\n<p><strong>VISTO </strong> il decreto-legge 6 giugno 2012, n. 74, convertito, con modificazioni, dalla legge 7 agosto 2012, n. 134, recante: “Interventi urgenti in favore delle popolazioni colpite dagli eventi sismici che hanno interessato il territorio delle province di Bologna, Modena, Ferrara, Mantova, Reggio Emilia e Rovigo, il 20 e il 29 maggio 2012”, ed in particolare l’art. 1, comma 2, che dispone che i Presidenti delle Regioni Emilia-Romagna, Lombardia e Veneto operano in qualità di Commissari delegati, nonché il comma 3, che proroga lo stato di emergenza in rassegna fino al 31 maggio 2013 e che dispone che  il rientro nel regime ordinario è disciplinato ai sensi dell'articolo 5, commi 4-ter e 4-quater, della legge 24 febbraio 1992, n. 225 ;</p>\n<p><strong>VISTI </strong> l'art. 6, comma 1, del decreto-legge 26 aprile 2013, n. 43, convertito, con modificazioni, dalla legge 24 giugno 2013, n. 71, l'art. 7, comma 9-ter, del decreto-legge 12 settembre 2014, n. 133, convertito, con modificazioni, dalla legge 11 novembre 2014, n. 164, l'art. 13, comma 1, del decreto-legge 19 giugno 2015, n. 78, convertito, con modificazioni, dalla legge 6 agosto 2015, n. 125, l'art. 11, comma 2-bis, del decreto-legge 30 dicembre 2015, n. 210, convertito, con modificazioni, dalla legge 25 febbraio 2016, n. 21, l'art. 2-bis, comma 44, del decreto-legge 16 ottobre 2017, n. 148, convertito, con modificazioni, dalla legge 4 dicembre 2017, n. 172, l'art. 15, comma 6, del decreto-legge 30 dicembre 2019, n. 162, convertito, con modificazioni, dalla legge 28 febbraio 2020, n. 8, l'art. 1, comma 459, della legge 30 dicembre 2021, n. 234, l'art. 1, comma 764, della legge 29 dicembre 2022, n. 197,  l’art. 1, comma 408 della legge 30 dicembre 2023, n. 213, ed, infine, l’art. 1, comma 649, della legge 30 dicembre 2024, n. 207, con cui lo stato di emergenza in rassegna è stato prorogato, da ultimo, al 31 dicembre 2025;</p>\n<p><strong>VISTO </strong> , altresì, l’art. 2, comma 6, del citato decreto-legge n. 74/2012, con cui si dispone, tra l’altro, che al Presidente della Regione Lombardia è intestata apposita contabilità speciale, su cui sono assegnate le risorse stanziate per fronteggiare l’emergenza in rassegna;</p>\n<p><strong>VISTO </strong> l’art. 17, comma 5 del decreto-legge 9 agosto 2022, n. 115, convertito, con modificazioni, dalla legge 21 settembre 2022, n. 142, con cui si autorizza la spesa di 1 milione di euro per l'anno 2022, 10 milioni di euro per l'anno 2023 e 10 milioni di euro per l'anno 2024, destinati a edifici, beni culturali e centri storici rientranti negli elenchi degli edifici danneggiati dal sisma 2012, già approvati alla data di entrata in vigore del medesimo decreto legge n. 115/2022 dal Commissario delegato della Regione Lombardia;</p>\n<p><strong>VISTO </strong> l’articolo 1, comma 411 della legge 30 dicembre 2023, n.213. con il quale, a fronte dell’elevata complessità e del numero dei fondi assegnati per la ricostruzione al territorio lombardo, è stato autorizzato lo svincolo delle rispettive finalità di ogni specifico fondo, disponendo che “<em>le somme disponibili nella contabilità speciale intestata al Commissario delegato alla ricostruzione per la regione Lombardia … sono utilizzate per la prosecuzione delle attività di ricostruzione pubblica e privata</em>”;</p>\n<p><strong>VISTA</strong> la nota della Regione Lombardia del 23 dicembre 2025, con cui, tra l’altro, si rappresenta la necessità di adottare apposita ordinanza di protezione civile ai sensi dell’articolo 26 del decreto legislativo n. 1/2018, al fine di consentire senza soluzione di continuità il completamento degli interventi già finanziati e delle iniziative di carattere solutorio rispetto alle obbligazioni certe, liquide ed esigibili assunte durante la vigenza dello stato di emergenza;</p>\n<p><strong>CONSIDERATO</strong> che per la Regione Lombardia non risulta adottata ulteriore disposizione legislativa di proroga dello stato di emergenza in rassegna;</p>\n<p><strong>CONSIDERATO </strong> che, nel corso del periodo di vigenza dello stato di emergenza, le risorse finanziarie stanziate per fronteggiare l’emergenza in rassegna, ai sensi dell’articolo 11 del citato decreto-legge n.74/2012 e dell’articolo 10, comma 13, del decreto-legge 22 giugno 2012, n.83 sono state interamente utilizzate dal Commissario delegato;</p>\n<p><strong>CONSIDERATO </strong> , altresì, che, nell’anno 2023, è stato assolto l’obbligo della restituzione all’entrata del bilancio dello Stato delle risorse che non utilizzate nei termini di legge riferite all’articolo 1, comma 762, della legge 27 dicembre 2017, n.205;  </p>\n<p><strong>RAVVISATA </strong> la necessità di disporre di una proroga temporalmente limitata della contabilità speciale, attesa la peculiarità del contesto emergenziale in rassegna, oggetto di plurime proroghe con provvedimenti normativi di rango primario, al solo fine di consentire il completamento degli ultimi interventi pianificati e dei correlati adempimenti contabili;</p>\n<p><strong>RITENUTO</strong> necessario, pertanto, adottare un’ordinanza ai sensi degli articoli 26 e 27, comma 5, del decreto legislativo 2 gennaio 2018, n.1, al fine di consentire senza soluzione di continuità il completamento degli interventi già approvati dal Commissario delegato e interamente finanziati durante la vigenza dello stato di emergenza;</p>\n<p><strong>ACQUISITA</strong> l’intesa della Regione Lombardia, da intendersi condizionata al mantenimento in essere della contabilità speciale n.5713/139 per un anno dalla cessazione dello stato di emergenza e alla possibilità, fino a termine della ricostruzione, di poter rimodulare i contributi concessi per gli ulteriori interventi necessari e le attività da porre in essere per concludere la ricostruzione, secondo le ordinarie procedure di spesa, con le disponibilità che residuano nella contabilità speciale;</p>\n<p><strong>DI CONCERTO </strong>con il Ministero dell’economia e delle finanze;</p>\n<p><strong>DISPONE </strong></p>\n<p><strong>ART.1 </strong></p>\n<ol><li>La Regione Lombardia è individuata quale Amministrazione competente alla prosecuzione, in via ordinaria, dell’esercizio delle funzioni del Commissario delegato di cui all’articolo 1, comma 2, del decreto-legge 6 giugno 2012, n. 74, convertito, con modificazioni, dalla legge 7 agosto 2012, n. 134 , nel coordinamento degli interventi, conseguenti agli eventi richiamati in premessa, pianificati e approvati dal predetto Commissario e non ancora ultimati.</li>\n<li>Per le finalità di cui al comma 1, il dr. Roberto Cerretti, attuale direttore vicario della Direzione Generale Territorio e Sistemi Verdi della Regione Lombardia è individuato quale soggetto responsabile delle iniziative finalizzate al completamento dei medesimi interventi e provvede, altresì, alla ricognizione ed all'accertamento delle procedure e dei rapporti giuridici pendenti, ai fini del definitivo trasferimento delle opere realizzate ai soggetti ordinariamente competenti.</li>\n<li>Entro 60 giorni dalla data di pubblicazione del presente provvedimento nella Gazzetta ufficiale della Repubblica italiana, il Commissario delegato di cui al comma 1 provvede ad<strong> </strong>inviare al soggetto responsabile di cui al comma 2 una relazione sulle attività svolte contenente l’elenco dei provvedimenti adottati, degli interventi conclusi e delle attività ancora in corso con relativo quadro economico.</li>\n<li>Il soggetto responsabile, che opera a titolo gratuito, per l'espletamento delle iniziative di cui alla presente ordinanza si avvale delle strutture organizzative della Regione Lombardia, nonché della collaborazione degli Enti territoriali e non territoriali e delle Amministrazioni centrali e periferiche dello Stato, che provvedono sulla base di apposita convenzione, nell’ambito delle risorse già disponibili nei pertinenti capitoli di bilancio di ciascuna Amministrazione interessata, senza nuovi o maggiori oneri per la finanza pubblica.</li>\n<li>AI fine di consentire il completamento degli interventi di cui al comma 2 e delle procedure amministrativo-contabili ad essi connessi, il predetto soggetto responsabile utilizza le risorse disponibili sulla contabilità speciale n.5713/139 aperta ai sensi del l’art. 2, comma 6, del citato decreto-legge n.74/2012, che viene al medesimo intestata fino al 31 dicembre 2026.</li>\n<li>Le risorse finanziarie residue presenti sulla contabilità speciale, alla data di chiusura della medesima, ove attribuite a interventi non ancora ultimati, ricompresi in piani approvati dal Dipartimento della protezione civile, sono trasferite al bilancio della Regione Lombardia che provvede, anche avvalendosi dei soggetti di cui al comma 4, nei modi ivi indicati, al completamento degli stessi. Eventuali somme residue rinvenienti al completamento di detti interventi, nonché le eventuali ulteriori risorse giacenti sulla contabilità speciale all’atto della chiusura della medesima, sono versate ad apposito capitolo di entrata del bilancio dello Stato e destinate, con la legge di bilancio, in coerenza con gli obiettivi programmatici di finanza pubblica, al Fondo per le emergenze nazionali oppure, ove originariamente provenienti da altre imputazioni di spesa del bilancio dello Stato, agli stati di previsione delle  Amministrazioni interessate. Le risorse residue provenienti da enti diversi dallo Stato vengono versate al bilancio degli stessi.</li>\n<li>Restano fermi gli obblighi di rendicontazione di cui all'articolo 27, comma 4, del decreto legislativo n. 1 del 2018.</li>\n</ol><p>La presente ordinanza, immediatamente esecutiva sarà pubblicata nella Gazzetta Ufficiale della Repubblica italiana.</p>\n<p>Roma, 28 maggio
