IL MINISTRO PER LA PROTEZIONE CIVILE E LE POLITICHE DEL MARE

\n

VISTA la legge del 23 agosto 1988, n. 400, recante «Disciplina dell'attività di Governo e ordinamento della Presidenza del Consiglio dei ministri»;

\n

VISTO il decreto legislativo 30 luglio 1999, n. 300, recante «Riforma dell’organizzazione del Governo, a norma dell’articolo 11 della legge 15 marzo 1997, n. 59»;

\n

VISTO il decreto legislativo del 30 luglio 1999, n. 303, recante «Ordinamento della Presidenza del Consiglio dei ministri, a norma dell'art. 11 della legge 15 marzo 1997, n. 59»;

\n

VISTO il decreto legislativo 2 gennaio 2018, n. 1, recante «Codice della protezione civile»;

\n

VISTO il decreto-legge 12 ottobre 2023, n. 140, convertito, con modificazioni, dalla legge 7 dicembre 2023, n. 183, recante «Misure urgenti di prevenzione del rischio sismico connesso al fenomeno bradisismico nell’area dei Campi Flegrei»;

\n

VISTO il decreto-legge 11 giugno 2024, n. 76, convertito, con modificazioni, dalla legge 11 giugno 2024, n. 76, recante «Disposizioni urgenti per la ricostruzione post-calamità, per interventi di protezione civile e per lo svolgimento di grandi eventi internazionali»;

\n

VISTA la legge di bilancio 30 dicembre 2024, n. 207 recante «Bilancio di previsione dello Stato per l’anno finanziario 2025 e bilancio pluriennale per il triennio 2025-2027» e, in particolare, l’articolo 1, commi 694 e seguenti;

\n

VISTO il decreto-legge 7 maggio 2025 n. 65, convertito, con modificazioni, dalla legge 4 luglio 2025, n. 101, recante «Ulteriori disposizioni urgenti per affrontare gli straordinari eventi alluvionali verificatisi nei territori di Emilia-Romagna, Toscana e Marche e gli effetti del fenomeno bradisismico nell'area dei Campi Flegrei, nonché disposizioni di carattere finanziario in materia di protezione civile»;

\n

VISTO, in particolare, l’articolo 11, comma 1, del citato decreto-legge 7 maggio 2025 n. 65, recante la sospensione dei termini in materia di adempimenti e versamenti tributari e contributivi, nonché in materia contrattuale per l’area dei Campi Flegrei, nei confronti dei “soggetti che alla data del 13 marzo 2025, avevano la residenza ovvero la sede legale o la sede operativa dichiarata alla competente camera di commercio, industria, artigianato e agricoltura in immobili:

\n

a)  danneggiati e sgomberati per inagibilità in esecuzione di provvedimenti adottati, entro la data di entrata in vigore del presente decreto, dalle competenti autorità in conseguenza degli eventi sismici del 13 marzo 2025 e del 15 marzo 2025 verificatisi nell'ambito della crisi bradisismica in atto nella zona dei Campi Flegrei;

\n

b)  danneggiati per i quali, alla data di entrata in vigore del presente decreto, sia stata chiesta la verifica di agibilità in conseguenza dei predetti eventi sismici del 13 marzo 2025 e del 15 marzo 2025 e, all'esito delle verifiche svolte, è disposto lo sgombero per inagibilità in esecuzione di provvedimenti adottati dalle competenti autorità”;

\n

VISTO l’articolo 11, comma 2, del citato decreto-legge 7 maggio 2025 n. 65, in forza del quale, con decreto del Ministro per la Protezione civile e le Politiche del mare, su proposta del presidente della Regione Campania, sentiti i comuni interessati, sono individuati i soggetti di cui all’articolo 11, comma 1, del medesimo decreto-legge n. 65 del 2025;

\n

VISTO il decreto del Presidente del Consiglio dei ministri in data 1° ottobre 2012, recante «Ordinamento delle strutture generali della Presidenza del Consiglio dei ministri»;

\n

VISTO il decreto del Presidente della Repubblica in data 21 ottobre 2022, con il quale il Sen. Nello Musumeci è stato nominato Ministro senza portafoglio;

\n

VISTO il decreto del Presidente del Consiglio dei ministri in data 10 novembre 2022, con il quale al Ministro senza portafoglio Sen. Nello Musumeci è stato conferito l’incarico per la protezione civile e le politiche del mare;

\n

VISTO il decreto del Presidente del Consiglio dei ministri in data 12 novembre 2022, con il quale al Ministro senza portafoglio Sen. Nello Musumeci è stato delegato l’esercizio delle funzioni di coordinamento, indirizzo, promozione d'iniziative anche normative, vigilanza e verifica, nonché di ogni altra funzione attribuita dalle vigenti disposizioni al Presidente del Consiglio dei ministri in materia di protezione civile, superamento delle emergenze e ricostruzione civile, nonché per le politiche del mare;

\n

VISTO il decreto del Presidente del Consiglio dei ministri in data 10 aprile 2024, recante «Regolamento di autonomia finanziaria e contabile della Presidenza del Consiglio dei ministri»;

\n

VISTO il decreto del Presidente del Consiglio dei ministri in data 28 marzo 2025, recante «Integrazione delle deleghe già conferite ai Ministri senza portafoglio»;

\n

VISTA la nota del Capo di Gabinetto del Ministro per la Protezione civile e le Politiche del mare, prot. n. 1300 del 9 maggio 2025, indirizzata al Capo di Gabinetto del Presidente della Regione Campania, con cui è stata chiesta la trasmissione della proposta regionale ai sensi dell’articolo 11, comma 2, del decreto-legge n. 65 del 2025;

\n

VISTA la nota della Regione Campania, prot. n. 13530 del 12 giugno 2025, con la quale il Capo di Gabinetto del Presidente della Regione Campania, d’ordine del Presidente della Regione Campania, in relazione al procedimento di cui all’articolo 11 del decreto-legge n. 65 del 2025:

\n

a) ha trasmesso la nota n. 293353 del 12 giugno 2025 della competente Direzione Generale regionale per i Lavori Pubblici e la Protezione Civile, recante, sulla base dei dati e delle integrazioni ricevuti dai Comuni di Napoli, Pozzuoli e Bacoli, l’elenco dei soggetti beneficiari delle misure agevolative previste dallo stesso articolo 11 del decreto-legge n. 65 del 2025;

\n

b) ha rappresentato, sulla base di quanto precisato dalla competente Direzione regionale con la stessa nota n. 293353/2025, che gli uffici regionali restavano in attesa di acquisire i dati relativi alle attività produttive e commerciali insistenti negli immobili sgomberati nel territorio del Comune di Napoli, necessari all’esatta individuazione dei beneficiari delle misure agevolative;

\n

c) ha rappresentato che avrebbe trasmesso tali ulteriori dati una volta ricevuti;

\n

VISTA la nota n. 293353 del 12 giugno 2025, con la quale la Direzione Generale regionale per i Lavori Pubblici e la Protezione Civile, sulla base degli elementi istruttori ricevuti dai Comuni interessati, ha trasmesso al Capo di Gabinetto del Presidente della Regione Campania un file aggiornato, comprensivo dei dati forniti dai Comuni di Napoli, Pozzuoli e Bacoli, contenente l’elenco dei soggetti potenzialmente beneficiari delle misure agevolative previste dall’articolo 11 del decreto-legge n. 65 del 2025 citato, precisando, altresì, che rimanevano da acquisire i dati relativi alle sole attività produttive e commerciali insistenti negli immobili sgomberati nel territorio del Comune di Napoli, necessari al completamento dell’istruttoria ai fini dell’individuazione dei beneficiari delle misure in parola;

\n

VISTA la nota del Capo di Gabinetto del Ministro per la Protezione civile e le Politiche del mare, prot. n. 1876 del 1° luglio 2025, con cui sono stati chiesti alla Regione Campania aggiornamenti in merito ai dati relativi alle attività produttive e commerciali insistenti negli immobili sgomberati nel territorio del Comune di Napoli, nonché, tenuto conto del rilevante numero di potenziali beneficiari oggetto della proposta regionale, è stato chiesto di confermare che i dati trasmessi con la precedente nota del 12 giugno 2025, n. 13530, corrispondessero effettivamente ai soggetti che, ai sensi di quanto previsto dall’articolo 11, comma 1, del decreto-legge n. 65 del 2025, avevano la residenza ovvero la sede legale o la sede operativa dichiarata alla competente camera di commercio, industria, artigianato e agricoltura negli immobili presi in considerazione dal medesimo articolo 11, comma 1, del decreto-legge n. 65 del 2025;

\n

VISTA la nota del Capo di Gabinetto del Ministro per la Protezione civile e le Politiche del mare, prot. n. 2194 del 1° agosto 2025, con cui – facendo seguito a quanto rappresentato con la citata nota prot. n. 1876 del 1° luglio 2025 - sono stati chiesti alla Regione Campania aggiornamenti sui dati relativi ai potenziali beneficiari, danneggiati o sgomberati, oggetto della proposta regionale ai sensi dell’articolo 11, comma 2, del decreto-legge n. 65 del 2025;

\n

VISTA la nota della Regione Campania, prot. n. 18395 del 5 agosto 2025, con la quale il Capo di Gabinetto del Presidente della Regione Campania, d’ordine del Presidente della Regione Campania, ha trasmesso la nota n. 386605 del 4 agosto 2025 della competente Direzione Generale regionale per i Lavori Pubblici e la Protezione Civile;

\n

VISTA la nota della Direzione Generale regionale per i Lavori Pubblici e la Protezione Civile, allegata alla nota regionale n. 18395 del 5 agosto 2025 cit., con cui la medesima Direzione Generale regionale:

\n

a) ha comunicato che, allo stato attuale, “non risultano pervenuti ulteriori aggiornamenti dei dati relativi ai potenziali beneficiari, oltre a quelli già comunicati, in ultimo con propria nota, prot. n. 310046 del 20 giugno 2025, comprensiva dell’allegato file contenente i dati forniti dai Comuni di Napoli, Pozzuoli e Bacoli”;

\n

b) ha rappresentato “[c]on riferimento, in particolare, ai dati riferiti alle persone fisiche residenti negli immobili sgomberati, […] che gli stessi sono riferiti ad un’ampia platea di potenziali beneficiari delle misure di cui all’articolo 11 del Decreto-Legge 7 maggio 2025, n. 65 e che, ai fini della loro puntuale individuazione, occorre far riferimento ai dati identificativi delle ordinanze di sgombero emesse dalle amministrazioni comunali interessate, di cui alle colonne G/H e K/L del file riepilogativo trasmesso con la citata nota di aggiornamento istruttorio”;

\n

c) ha evidenziato che in contesti emergenziali analoghi, è prassi consolidata procedere all’individuazione dei beneficiari mediante l’acquisizione di autocertificazione in merito al possesso dei requisiti per l’accesso alle misure agevolative;

\n

VISTA la nota del Capo di Gabinetto del Ministro per la Protezione civile e le Politiche del mare, prot. n. 2249 del 7 agosto 2025, con cui, in relazione a quanto rappresentato dalla Regione con nota prot. n. 18395 del 5 agosto 2025:

\n

a) è stato rilevato che l’Ufficio di Gabinetto del Ministro per la protezione civile e le politiche del mare disponeva, ai fini dell’adozione del decreto ministeriale ai sensi dell’articolo 11, comma 2, del decreto-legge n. 65 del 2025, dei soli elementi forniti dalla medesima Regione Campania con la nota n. 13530 del 12 giugno 2025, che rinviava ad una nota della stessa Direzione Generale regionale per i Lavori Pubblici e la Protezione Civile del 12 giugno 2025, n. 293353, come tale anteriore rispetto a quella, del 20 giugno 2025, richiamata dalla Regione nella propria nota n. 18395 del 5 agosto 2025;

\n

b) è stato chiesto alla Regione, al fine di individuare in maniera univoca i beneficiari delle misure agevolative previste dal richiamato articolo 11 del decreto-legge n. 65 del 2025, da un lato, di trasmettere, per completezza di istruttoria, la nota n. 310046 del 20 giugno 2025 cit. e il relativo allegato - trattandosi di atti e documenti espressamente richiamati nella corrispondenza da porre a base del decreto ministeriale -, dall’altro, di chiarire se la nota n. 310046 del 20 giugno 2025 e il relativo allegato, ai fini dell’adozione del decreto ministeriale, sostituissero la nota n. 13530 del 12 giugno 2025 e il relativo allegato, con la conseguente necessità di intendere la proposta regionale di adozione del decreto ministeriale in parola come riferita ai soli elementi desumibili dalla nota n. 310046 del 20 giugno 2025 e dal suo allegato;

\n

VISTA la nota della Regione Campania, prot. n. 18581 del 7 agosto 2025, con la quale il Capo di Gabinetto del Presidente della Regione Campania, in riscontro alla succitata nota prot. n. 2249 del 7 agosto 2025:

\n

a) ha inviato la nota prot. n. 310046 del 20 giugno 2025 con cui “la competente Direzione Generale per i lavori Pubblici e la Protezione Civile ha trasmesso, in sostituzione dell’elenco trasmesso con nota prot. 293353 del 12/06/2025, il file aggiornato concernente i dati relativi alle persone fisiche e alle attività commerciali destinatarie degli interventi previsti dalla norma in oggetto”;

\n

b) ha precisato che “non sono pervenuti, ad oggi, ulteriori aggiornamenti rispetto all’elenco allegato alla nota prot. 310046 del 20 giugno 2025”.

\n

VISTA la nota prot. n. 310046 del 20 giugno 2025 – allegata alla nota regionale prot. n. 18581 del 7 agosto 2025 – con cui la Direzione Generale per i Lavori Pubblici e la Protezione Civile della Regione Campania, sulla base di apposito aggiornamento pervenuto dal Comune di Napoli, ha trasmesso al Capo di Gabinetto del Presidente della Regione Campania “il file aggiornato che recepisce le integrazioni pervenute e sostituisce il precedente”, pure evidenziando che, per alcune attività produttive e commerciali con sede negli immobili oggetto di provvedimenti di sgombero, risultavano ancora mancanti il numero di Partita IVA e/o il numero di iscrizione alla CCIAA, informazioni necessarie per la completa individuazione dei potenziali beneficiari;

\n

RITENUTO NECESSARIO, ai sensi dell’articolo 11, comma 2, del decreto-legge n. 65 del 2025 citato, sulla base degli elementi istruttori da ultimo acquisiti attraverso la nota regionale n. 18581 del 7 agosto 2025, provvedere in via immediata all’individuazione dell’elenco di soggetti di cui all’articolo 11, comma 1, del medesimo decreto-legge n. 65 del 2025;

\n

CONSIDERATO CHE la Regione Campania ha precisato, con la nota n. 18581 del 7 agosto 2025, che “il file aggiornato concernenti i dati relativi alle persone fisiche e alle attività commerciali destinatarie degli interventi previsti dalla norma in oggetto” corrisponde all’elenco allegato alla nota prot. n. 310046 del 20 giugno 2025 della Direzione Generale per i Lavori Pubblici e la Protezione Civile della medesima Regione Campania;

\n

CONSIDERATO, pertanto, che i soggetti di cui all’articolo 11, comma 1, del decreto-legge 7 maggio 2025, n. 65, devono essere individuati in quelli inseriti nell’elenco trasmesso dalla Regione Campania con nota n. 18581 del 7 agosto 2025, corrispondente all’elenco allegato alla nota prot. n. 310046 del 20 giugno 2025 della Direzione Generale per i Lavori Pubblici e la Protezione Civile della medesima Regione Campania;

\n

CONSIDERATO CHE, come precisato nella nota regionale del 4 agosto 2025 della Direzione Generale per i Lavori Pubblici e la Protezione Civile della medesima Regione Campania, trasmessa con nota regionale n. 18395 del 5 agosto 2025, ai fini della puntuale individuazione delle persone fisiche residenti negli immobili sgomberati, occorre fare riferimento ai dati identificativi delle ordinanze di sgombero adottate dalle amministrazioni comunali interessate, di cui all’elenco allegato alla nota regionale n. 310046 del 20 giugno 2025 citata;

\n

CONSIDERATO CHE l’elenco dei soggetti di cui all’articolo 11, comma 1, del decreto-legge n. 65 del 2025 è stato predisposto dalla Regione sentiti i Comuni interessati, in quanto definito sulla base dei dati e delle integrazioni ricevuti dai Comuni di Napoli, Pozzuoli e Bacoli;

\n

SU PROPOSTA del Presidente della Regione Campania, d’ordine del quale sono state adottate le citate note regionali propedeutiche al presente decreto;

\n

DECRETA

\n

ART. 1
(Individuazione dei soggetti di cui all’articolo 11, comma 1, del decreto-legge n. 65 del 2025)

\n
  1. I soggetti di cui all’articolo 11, comma 1, del decreto-legge 7 maggio 2025, n. 65, convertito, con modificazioni, dalla legge 4 luglio 2025, n. 101, sono individuati nell’elenco allegato al presente decreto di cui costituisce parte integrante.
  2. \n

ART. 2
(Clausola di invarianza finanziaria)

\n
  1. Il presente decreto non comporta nuovi o maggiori oneri a carico della finanza pubblica.
  2. \n

\nIl presente decreto è trasmesso ai competenti organi di controllo.
